Employer Sponsored – Permanent Visa Solutions

The Employer Nomination Scheme (ENS) provides permanent residency to migrants who are already in Australia working as temporary residents and those living outside Australia equipped with the desired skill sets that are in demand in Australia.

Employer Nomination Scheme visa (subclass 186)

The ENS visa scheme has three visa streams:

1 - Direct entry:

Applicants with significant occupational experience can be sponsored directly from their country of origin, without transitioning through temporary employment in Australia.  Applicants in this stream require a greater duration of occupational experience and a formal skills assessment.

  • have an occupation that is on the list of eligible skilled occupations
  • have at least 3 years relevant work experience, unless you are exempt
  • have a positive skills assessment, unless you are exempt

2 - Temporary residence transition stream (TRT):

The TRT scheme is a pathway utilised for workers currently holding temporary status and are transitioning to permanency after fulfilling visa conditions of previously held visas.  Broadly this scheme requires the applicant to:

  • hold a subclass 457, TSS or related Bridging visa A, B or C
  • usually, have worked for your employer for at least 3 years full time while holding a subclass 457 or TSS visa
  • have been nominated by an Australian employer whose nomination was approved in the 6 months before you apply

3 -Labour agreement stream

These are specialised agreements developed between the Australian Government and employers. The Labour Agreement stream can be used for migrants that currently work, or will work, for an employer who is party to a labour agreement. Applicants must have suitable English language skills, experience, skills and other attributes for the position. The labour agreement will provide guidance on these.

Successful grant of these permanent visas allow applicants to:

  • stay in Australia indefinitely
  • work and study in Australia
  • enrol in Australia’s public health care scheme, Medicare
  • sponsor eligible relatives to come to Australia
  • travel to and from Australia for 5 years
  • apply for Australian citizenship, if eligible
